A pichação é um meio de manifestação do pensamento que remonta ao período
pré-histórico. Desde então, seu uso foi disseminado e progressivamente aceito pela
sociedade, passando a ser considerado, inclusive, uma forma de arte urbana. Um dos
usos mais comuns da pichação é como mecanismo de manifestação política, seja
através de mensagens de caráter ideológico, seja com pedido de voto. A legislação
eleitoral brasileira tradicionalmente apontava a pichação como mecanismo lícito
de propaganda eleitoral, contudo, com a edição da Lei nº 13.165/2015, seu uso foi
proibido. O novo regramento tinha por objetivo reduzir os custos das campanhas
eleitorais e acabou atingindo a liberdade de expressão. O presente trabalho objetiva,
através da revisão bibliográfica e análise jurisprudencial, discutir o uso da pichação
como meio de manifestação política.

Since then, its use has been disseminated and, progressively, accepted by society, even being considered an urban art form. One of the most common uses of the graffiti is as a mechanism of political manifestation, either through messages of ideological character or with a request for vote. The Brazilian electoral legislation traditionally pointed to graffiti as a legitimate mechanism of electoral propaganda, however, with the publication of Law nº 13.165/2015, its use was prohibited. The new rule aimed at reducing the costs of election campaigns, and ended up affecting free speech.
