Interdição e direito de voto

Abstract

Apresenta e discute o direito de voto das pessoas interditadas assegurado pelo Estatuto da Pessoa com Deficiência e o desafio na implementação desta política pública em relação às interdições decretadas anteriormente à vigência da lei e já registradas pela Justiça Eleitoral. Optou-se pela revisão bibliográfica e pela análise documental como principais ferramentas. O principal marco teórico utilizado para explicar a dificuldade de implementação imediata do Estatuto às interdições anteriores é a Teoria da Construção Social das Populações-alvo, que centra a discussão no imaginário social como importante componente na formação da agenda das políticas públicas. Pretende-se com a pesquisa levantar o debate acerca do direito de os interditados terem efetivo acesso ao voto, frente às mudanças legais e Constitucionais trazidas pelo novo paradigma da deficiência no Brasil.It discusses the voting rights of the interdicted persons ensured by the Statute of the Disabled and the challenge in the implementation of this public policy in relation to the interdictions decreed before the Law's validity and already registered by the Electoral Justice. It choses the literature review and document analysis as the main tools. The main theoretical framework used to explain the difficulty of immediate implementation of the Statute to previous interdictions is the Theory of Social Construction of the Target Populations, which focuses the discussion on the social imagination as an important component in shaping the public policy agenda. The aim of the research is to raise the debate about the right of the interdicted to have effective access to the vote, given the legal and constitutional changes brought about by the new paradigm of disability in Brazil.
