Democracia e cassação de mandato pela Justiça Eleitoral

Abstract

Aborda o aparente conflito entre dois institutos: o do voto popular, de onde se manifesta o poder do povo, e a cassação de mandatos, de onde o Judiciário procede com vistas a garantir a legalidade. É demonstrado que, apesar de ambos terem a mesma finalidade teórica, pode haver um conflito entre os dois, gerando dissenso doutrinário acerca do tema.It addresses the apparent conflict between two institutes: the popular vote, by which the will of the people is manifested, and removal from office, by which the judiciary seeks to guarantee legality. We demonstrate that although both have the same theoretical purpose, they can conflict with each other, reflected in the dissention in the doctrine from legal scholars.
