O poder normativo do TSE frente às limitações previstas no projeto do novo código eleitoral (PL112/2021) : avanços ou retrocessos ante o sistema de freios e contrapesos?

Abstract

Analisa as restrições ao Poder Normativo do Tribunal Superior Eleitoral previstas no projeto do Novo Código Eleitoral (PLP n. 112/2021), que foi aprovado na Câmara, e que se encontra tramitando no Senado. Há a finalidade de responder se as limitações previstas serão capazes de promover avanços, restabelecendo o sistema de freios e contrapesos que deve existir entre os poderes Legislativo e Judiciário, afastando os abusos, ou se irão retroceder diante desta perspectiva. Para tanto, utiliza-se como metodologia a histórico-comparativa, a jurídico-descritiva e a analítica, além de serem usadas técnicas de pesquisa bibliográfica e documental. A pesquisa tem como objetivo estudar a evolução da Teoria da Separação de Poderes, a fim de entender o funcionamento do sistema de pesos e contrapesos; analisar as Resoluções n. 23.709/2022, alterada pela de n. 23.717/2023, identificando o desvirtuamento do Poder Regulamentar do TSE diante do previsto no Código Eleitoral atual, frente ao Poder Normativo exercido nessas edições. Além de analisar o novo projeto do Código Eleitoral, apontando acertos e desacertos diante do sistema de freios e contrapesos.

It seeks to analyze the restrictions on the Normative Power of the Superior Electoral Court provided for in the project of the New Electoral Code (PLP n. 112/2021), which was approved in the Chamber of Deputies, and is currently being processed in the Senate. There is a purpose of answering whether the predictions will be able to promote progress, reestablishing the system of checks and balances that must exist between the Legislative and Judicial branches ,preventing abuses, or whether they will regress in view of this perspective. To this end, historical-comparative, legal-descriptive and analytical methodology are used, in addition to bibliographic and documentary research techniques. The research aims to study the evolution of the Theory of Separation of Powers, in order to understand how the system of checks and balances works; to analyze Resolutions no. 23/09/2022, amended by n. 23,717/2023, identifying the distortion of the Regulatory Power of the TSE in relation to what is foreseen in the current Electoral Code, in relation to the Normative Power exercised in these editions. In addition to analyzing the new draft of the Electoral Code pointing out successes and failures regarding the system of checks and balances.
