Análise contemporânea da estrutura normativa do sistema processual eleitoral português

Abstract

Aborda as características distintivas do sistema eleitoral português, com o objetivo de apresentar e refletir sobre os órgãos de atuação, suas funções, finalidades e limitações no contexto do contencioso eleitoral em Portugal. A análise parte do entendimento de que o Direito Eleitoral em Portugal se entrelaça com o Direito Constitucional, examinando as liberdades, garantias e limitações previstas na Constituição para compreender a participação popular na escolha de representantes e os princípios que fundamentam o processo eleitoral.

It addresses the distinctive characteristics of the Portuguese electoral, with the aim of presenting and reflecting on the operating bodies, their functions, purposes and limitations in the context of electoral litigation in Portugal. The analysis is based on the understanding that Electoral Law in Portugal is intertwined with Constitutional Law, examining the freedoms, guarantees and limitations provided for in the Constitution to understand popular participation in the choice of representatives and the principles that underlie the electoral process.
