Legitimidade democrática da jurisdição constitucional : um diálogo entre as correntes substancialista e procedimentalista

Abstract

Investiga a legitimidade democrática da jurisdição constitucional, partindo da análise de duas correntes da filosofia constitucional contemporânea: o procedimentalismo, através da análise do discurso de John Hart Ely, e o substancialismo, sob a ótica de Mauro Cappelletti. Superando a dicotomia dos discursos de legitimidade democrática, é apresentada a relação harmoniosa entre as duas correntes, defendendo-se, ao fim, que o alcance da ideia procedimentalista pressupõe uma atuação substancialista da jurisdição constitucional, em busca de um objetivo comum: defesa de direitos fundamentais.It investigates the democratic legitimacy of the constitutional jurisdiction, starting from the analysis of two currents of the contemporary constitutional philosophy: proceduralism, through the analysis of the discourse of John Hart Ely, and the substantialism, from the perspective of Mauro Cappelletti. Overcoming the dichotomy of the discourses of democratic legitimacy, the harmonious relationship between the two currents will be presented, defending, in the end, that the reach of the procedimentalist idea presupposes a substantialist action of the constitutional jurisdiction, in search of a common objective: defense of rights fundamental principles.
