O devido processo legislativo na jurisprudência do STF

Abstract

Analisa a importância do devido processo legislativo para a garantia da democracia. Precisamente, o texto analisa três hipóteses de violações a esse princípio fundamental e o papel da jurisdição constitucional em conter arbítrios e ilegalidades de maiorias eventuais capazes de subverter a ordem constitucional.It analyzes the importance of the due legislative process for ensuring democracy. To that aim, the text analyzes three hypotheses of breaches to this fundamental principle and the role of constitutional jurisdiction in containing discretion and illegalities of occasional majorities, capable of subverting the constitutional order.
