A elegibilidade dos militares no processo eleitoral brasileiro

Abstract

A elegibilidade de militares tende a ganhar cada vez mais expressividade no âmbito do Direito Eleitoral, pois, com base nas últimas eleições, notou-se um crescimento no número de registros de candidaturas de militares perante a Justiça Eleitoral. Desse modo, destaca-se que, para o militar concorrer ao pleito eleitoral, algumas particularidades devem ser observadas, as quais se distinguem da sistemática de participação do cidadão não militar. Portanto, no presente artigo busca-se demonstrar não apenas as diferentes etapas impostas pelo ordenamento jurídico brasileiro, mas também apontar o entendimento dos tribunais eleitorais para que o militar elegível possa exercer sua capacidade eleitoral passiva, direito que lhe é assegurado pela Constituição Federal de 1988, visando à interdisciplinaridade entre os Direitos Eleitoral e Militar.The eligibility of the military tends to gain more and more significance in the sphere of electoral law, since, based on the last elections, there has been an increase in the number of registrations of military candidacies in the Electoral Court. Thus, it is highlighted that, for the military to run for election, some particularities must be observed, which distinguish from the systematic of non-military citizens participation. Therefore, this article seeks to demonstrate not only the different stages imposed by the Brazilian legal system but also to point out the understanding of the Electoral Courts so that the eligible military can exercise their passive electoral capacity, a right guaranteed by the Federal Constitution of 1988, aiming at the interdisciplinarity between Electoral and Military Laws.
