Eleições suplementares e o princípio da soberania popular

Abstract

Confirmada a decisão de indeferimento de registro de candidatura, ou ainda, que importe na cassação de mandato de candidato eleito em pleito majoritário, o Tribunal deverá convocar eleições suplementares, independentemente do trânsito em julgado. É possível a participação do vice porventura cassado no pleito ordinário na condição de "mero beneficiário", haja vista que a inelegibilidade de um dos candidatos não atinge o outro componente da chapa majoritária.
