A fraude nas cotas de gênero : análise do julgamento do RESPE 19.392-PI e suas implicações jurídicas

Abstract

Apresenta um estudo aprofundado sobre a decisão proferida pelo TSE na ação REspe 19.392-PI em relação às sanções cabíveis no caso das fraudes nas candidaturas femininas, especificamente no que toca à cassação do registro de candidatura e dos mandatos: se seria aplicável às candidatas-laranja e aos reais beneficiários da conduta ilícita ou atingiria todos os candidatos que compuseram o registro de candidatura. Discutiu-se, ainda, a repercussão da decisão na efetividade da ação afirmativa para fomentar a participação feminina na política e outras proposições, de cunho legislativo e jurídico, com o objetivo de inibir a conduta ilícita da fraude à cota de gênero com uso de candidatas-laranja.

It presents an in-depth study of the decision handed down by the TSE in action REspe 19.392-PI with regard to the applicable sanctions in the case of fraud in women's candidacies, specifically with regard to the de-registration of candidacies and removal from office: whether it would apply to the orange candidates and the real beneficiaries of the unlawful conduct or whether it would affect all the candidates who made up the candidacy register. The repercussions of the decision on the effectiveness of affirmative action to foster women's participation in politics and other legislative and legal proposals to inhibit the illicit conduct of gender quota fraud with the use of orange candidates were also discussed.
