O procedimento de consulta ao Tribunal Superior Eleitoral : o novo Código de Processo Civil e a segurança jurídica

Abstract

Apresenta fundamentos para que, sob a ótica do Novo Código de Processo Civil, as respostas abstratamente concebidas às consultas formuladas ao Tribunal Superior Eleitoral possuam efeito vinculante perante a própria Corte Superior e, consequentemente, perante todas as instâncias da Justiça Eleitoral. A partir desse novo enfoque, trabalha-se, ainda, com a aplicabilidade do instituto processual do amicus curiae ao procedimento estudado. Desse modo, o objetivo é conferir nova perspectiva ao instituto jurídico da consulta à Corte Superior, cujas utilidade e relevância são inegáveis no ordenamento jurídico brasileiro. Conclui-se que, com a adoção da eficácia vinculante proposta, seriam privilegiadas a estabilização das decisões e a primazia da segurança jurídica.

It presents grounds so that, from the point of view of the New Code of Civil Procedure, the answers, abstractly conceived, to the consultations formulated to the Superior Electoral Court have binding effect before the High Court itself and, consequently, before all instances of the Electoral Justice. From this new approach, we also work with the applicability of the amicus curiae procedural institute to the procedure studied. In this way, the objective is to give a new perspective to the legal institute of consultation to the Superior Court, whose utility and relevance are undeniable in the Brazilian legal system. It is concluded that, with the adoption of the proposed binding effect, the stabilization of decisions and the primacy of legal certainty would be very privileged.
