Eleições para juiz de paz e a plenitude dos direitos políticos

Abstract

Apresenta informações coletadas em pesquisa exploratória que procurou identificar os possíveis motivos que impedem a concretização da norma constitucional que reestabelece a justiça de paz como magistratura eletiva. A pesquisa estudou as condições de elegibilidade, a vinculação ou não do cargo de juiz de paz ao sistema eleitoral e partidário brasileiro, a recepção constitucional do Código Eleitoral no que tange à eleição para juiz de paz e a competência da Justiça Eleitoral para exercício do poder normativo na regulamentação dos procedimentos eleitorais para seleção dos candidatos à justiça de paz. Assim, a pesquisa visa se familiarizar com o problema para auxiliar na produção de hipóteses para explicar por que ainda não ocorreram eleições para juízes de paz passados 25 anos da promulgação da Constituição

It presents informations collected in an exploratory research seeking to identify the possible reasons that prevent the realization of the constitutional provision which reestablishes election to the office of Justice of the Peace. The research studied the eligibility conditions, binding or not the office of Justice of the Peace to the Brazilian electoral and party system, the constitutional compatibility of the Electoral Code regarding the election for Justice of the Peace and the competence of the Electoral Justice in order to regulate the electoral procedures for selection for Justice of the Peace. The research aims to familiarize with the problem and assist in producing hypotheses to explain why has not yet occurred any election for Justices of the Peace since the promulgation of the Brazilian Constitution in 1988.
