Direito eleitoral comparado entre Portugal e Brasil : análise do instituto da inelegibilidade do juiz de paz

Abstract

Analisa o instituto da inelegibilidade dos juízes de paz no ordenamento jurídico português, bem como no brasileiro. Para tal, traz à baila o entendimento proferido no Acórdão nº 250/2009, do Processo nº 389/2009, de relatoria do Conselheiro Benjamim Rodrigues, do Tribunal Constitucional de Portugal, em que se consignou a inelegibilidade dos juízes de paz em Portugal. Já no Brasil, por meio do julgamento da Ação Direta de Inconstitucionalidade nº 2.938-0/MG, cuja relatoria ficou a cargo do Ministro Eros Graus, demonstrou-se a capacidade eleitoral passiva do juiz de paz. Para tanto, utilizou-se como metodologia a pesquisa bibliográfica - método dedutivo -, por meio da análise textual, temática e interpretativa de obras jurídicas sobre o tema, assim como a pesquisa documental, por meio da análise de conteúdo da Constituição Federal no que tange às normas inerentes ao tema.

It analyzes the institute of ineligibility of the justices of the peace in the Portuguese legal system, as well as in the Brazilian. It brought to light the understanding rendered in Judgment nº 250/2009, of Case nº 389/2009, of the Rapporteur of Counselor Benjamim Rodrigues, of the Constitutional Court of Portugal, which determined the ineligibility of the justices of the peace in Portugal. In Brazil, the judgment of the Direct Action of Unconstitutionality nº 2938-0/MG, whose Rapporteur was in charge of the Minister Eros Graus, demonstrated the passive electoral capacity of the justice of the peace. For this, the type of bibliographic research, as a deductive method, was used as a methodology, through the textual, thematic and interpretative analysis of legal works on the subject, as well as the type of documentary research, through the analysis of the content of the Federal Constitution the norms inherent to the topic.
