Ouvidorias eleitorais : instrumentos de accountability e de responsividade da Justiça Eleitoral

Abstract

Investiga as bases constitucionais e legais para a construção de uma visão das ouvidorias eleitorais como instrumentos fomentadores da accountability em face da Justiça Eleitoral e da responsividade desse ramo especializado da Justiça, assentadas sobre os princípios estruturantes da dignidade humana, do Estado democrático de direito, da cidadania e da soberania popular. Para tanto enfrenta três correspondentes objetivos específicos: (i) analisar a ressignificação do conceito publicidade dos atos administrativos, desde a conformação inaugural desse princípio com a Carta de 1988, passando-se pelo advento da Lei da Transparência e da Lei de Acesso à Informação, consentâneos com a nova feição do direito administrativo, cujo princípio estruturante passa da supremacia do interesse público à dignidade da pessoa humana e, consequentemente, da soberania popular com respeito à minorias; (ii) analisar como a atuação normativamente imposta às ouvidorias, seja na sua feição passiva ou ativa, é consentânea com a concretização da cidadania informacional; (iii) analisar como a transparência, o acesso à informação e a atuação das ouvidorias - notadamente após o advento do Código de Defesa do Usuário de Serviços Públicos - fomentam o controle e a eficiência da gestão pública.

It investigates the constitutional and legal bases for the construction of a vision of electoral ombudsmen as instruments that foster accountability in the face of electoral justice and the responsiveness of this specialized branch of justice, based on the structuring principles of human dignity, democratic rule of law, citizenship and popular sovereignty. To this end, it has three corresponding specific objectives: (i) to analyze the resignification of the concept of publicity of administrative acts, since the inaugural conformation of this principle with the Charter of 1988, passing through the advent of the Transparency Law and the Access to Information Act, consistent with the new feature of administrative law, whose structuring principle ranges from the supremacy of the public interest to the dignity of the human person, and hence popular sovereignty with respect to minorities; (ii) to analyze how the action normatively imposed on the ombudsman, whether in its passive or active features, is consistent with the realization of informational citizenship; (iii) analyze how transparency, access to information and the performance of ombudsmen - notably after the advent of the Public Services User Defense Code - fosters the control and efficiency of public management.
