Tribunais constitucionais e democracia no século XX

Abstract

Realiza uma breve explanação do papel dos Tribunais Constitucionais na consolidação de democracias contemporâneas ao longo do século XX. Apresenta-se, inicialmente, o processo de expansão da jurisdição constitucional, desde a construção pretoriana nos Estados Unidos da América, no caso Marbury versus Madison, em 1803, até a consagração dos tribunais constitucionais na segunda metade do século XX, com a queda de regimes totalitaristas na Europa, África, Ásia e América do Sul, em contextos políticos de amplos movimentos de redemocratização. Ao fim, faz-se uma breve apresentação dos tribunais constitucionais e das supremas cortes no contexto latino-americano.It explains the role of Constitutional Courts in the consolidation of contemporary democracies throughout the twentieth century. Initially, the process of expanding judicial review is presented, from the praetorian construction in the United States of America in the Marbury v. Madison case in 1803 to the consecration of constitutional courts in the second half of the twentieth century, with the fall of totalitarian regimes in Europe, Africa, Asia and South America, in political contexts of broad redemocratization movements. Finally, a brief presentation of the constitutional courts and supreme courts in the Latin American context is presented.
