Abstract

Indaga-se sobre a qual dos poderes legislativos compete estabelecer as regras para a execução do art. 70 da Constituição Federal, que determina as bases da legislação ordinária, em todo o Brasil, com referência aos direitos políticos: ao Poder Legislativo estadual ou ao Poder Legislativo nacional? Conclui-se que restou dirimida qualquer dúvida quanto à competência legislativa em matéria eleitoral no regime federativo brasileiro, sendo a competência exclusiva da União; é privativamente federal, nada se delegando aos estados e aos municípios neste particular.It inquires about which of the legislative powers it is responsible to establish the rules for the execution of art. 70 of the Federal Constitution, which establishes the bases of ordinary legislation throughout Brazil with reference to political rights? To the state Legislative Power or to the national Legislative Power? It concludes that any doubts have been settled regarding the legislative competence in electoral matters in the Brazilian federal system: the competence is exclusive to the Union, it is exclusively federal, and nothing is delegated to the states and municipalities in this particular.
