Democracia deliberativa e regulação eleitoral na América Latina : Brasil, México e Colômbia em perspectiva comparada

Resumo
Investiga a presença de deliberação democrática nas instituições eleitorais
de Brasil, México e Colômbia, com base nas teorias da democracia deliberativa e
dos diálogos institucionais. Parte-se da premissa de que a legitimidade das normas
eleitorais está vinculada à abertura procedimental, à participação qualificada e à
articulação entre funções institucionais. O modelo brasileiro é tomado como ponto de
partida da análise em razão de sua configuração singular, que combina competências
jurisdicionais, normativas e canais formais de escuta pública, como as audiências
promovidas pelo Tribunal Superior Eleitoral (TSE). A pesquisa adota a metodologia da
Análise Qualitativa Comparativa (QCA), com base em quatro variáveis: judicialização,
competência normativa, participação social e grau de centralização funcional. Os
resultados indicam diferentes arranjos institucionais, com distintas combinações entre
as variáveis analisadas: o Brasil apresenta uma configuração integrada de competências,
com mecanismos formais de participação e desafios quanto à efetividade deliberativa;
o México adota um modelo dual, com autonomia normativa e capacidade técnica, mas
com baixa institucionalização dos canais de escuta; já a Colômbia opera com um sistema
misto e fragmentado, em que a justiça eleitoral é exercida por órgãos distintos e sem
jurisdição especializada, o que impõe limites à coerência normativa e à deliberação
pública. Conclui-se que determinadas combinações institucionais, como a presença de
judicialização especializada, normatividade clara, escuta institucionalizada e coerência
funcional, tendem a favorecer processos regulatórios mais abertos e responsivos,
enquanto arranjos mais fragmentados colocam desafios adicionais à transparência e à
legitimidade democrática.
It investigates the presence of democratic deliberation within the electoral institutions of Brazil, Mexico, and Colombia, drawing on theories of deliberative democracy and institutional dialogue. It is based on the premise that the legitimacy of electoral norms is linked to procedural openness, qualified participation, and the articulation between institutional functions. The Brazilian model is used as a starting point for analysis due to its unique configuration, which combines jurisdictional, normative, and participatory functions, including formal channels of public consultation such as the public hearings held by the Superior Electoral Court (TSE). The research employs the Qualitative Comparative Analysis (QCA) methodology, based on four variables: judicialization, normative competence, social participation, and degree of functional centralization. The results indicate distinct institutional arrangements, with different combinations across the analyzed variables: Brazil presents an integrated configuration of competencies, with formal participatory mechanisms and challenges regarding deliberative effectiveness; Mexico follows a dual model, with normative autonomy and technical capacity, but low institutionalization of listening mechanisms; and Colombia operates with a mixed and fragmented system, in which electoral justice is exercised by distinct bodies without specialized jurisdiction, which limits normative coherence and public deliberation. The study concludes that certain institutional combinations, such as specialized judicialization, clear normativity, institutionalized listening, and functional coherence, tend to foster more open and responsive regulatory processes, while more fragmented arrangements pose additional challenges to procedural transparency and democratic legitimacy.
