Recurso contra expedição de diploma no contexto do processo eleitoral efetivo

Abstract

Analisa a influência das modificações operadas pela decisão do Tribunal Superior Eleitoral exarada no RCED 884/PI e pela Lei 12.891/13, no âmbito de aplicabilidade do Recurso Contra Expedição de Diploma. Busca-se aferir, após as citadas alterações, a aptidão desse instrumento processual para garantir de forma efetiva a tutela dos bens jurídicos relacionados à regularidade e lisura das eleições.It analyzes the influence of the alterations deriving from the decision of the Superior Electoral Court of Brazil in RCED 884/PI and from the Law 12.891/13, regarding the applicability of the 'Recurso Contra Expedição de Diploma'. Taking into account the aforementioned modifications, this paper intends to assess the aptitude of this remedy for ensuring election fairness and the effective protection of legal interests.
