Entre o tribunal e o parlamento : a atualidade das lições dos casos de verticalização e fidelidade partidárias no contexto do papel das instituições na reforma política

Resumo
A partir da releitura dos casos de verticalização e fidelidade
partidárias julgados pela Suprema Corte, este texto pretende extrair uma
lição que se mostre atual e pertinente ao momento de instabilidade que vive
a República. A ideia apresentada é a de que a atuação do Supremo Tribunal
Federal, nitidamente permeada pelo discurso neoconstitucionalista, acaba
por, inadvertidamente, invadir espaços de construção prioritariamente
política do Direito. O Tribunal desconsidera, assim, a importância dos
partidos políticos e a sua posição de protagonismo no nosso desenho
constitucional como o principal canal de diálogo da sociedade civil com
o seu governo. A lição que se aprende, notadamente em razão da EC
52/2006 como uma resposta firme do Parlamento ao Judiciário, é a de
que as decisões do Supremo Tribunal Federal, conquanto nitidamente
reformadoras das regras da disputa política, deverão manter-se apenas
na medida em que aceitável da perspectiva majoritária do Parlamento

The lesson learned, particularly due to the Constitutional Amendment n. 52/2006 as a firm response from the Parliament to the judiciary, is that the decisions of the Supreme Court, although clearly reforming the rules of the political dispute, should remain only insofar acceptable where the majority view of Parliament
