A responsabilidade civil pela perda de uma chance nas eleições : mais um mecanismo apto a moralizar o processo eleitoral

Abstract

Analisa a possibilidade de reparação de danos decorrentes de atos antijurídicos praticados pelos candidatos durante a eleição e com potencial de ocasionar a perda da chance de seus adversários ascenderem ao poder. A expectativa é que a coerção indireta exercida por fenômeno desse jaez obste, ao menos em parte, a prática de ilicitudes durante a disputa eleitoral. Visa-se, assim, conferir proteção tanto aos candidatos quanto à própria sociedade. O desenvolvimento inicia-se pelo conceito e pontos de relevo da Responsabilidade Civil, após, segue-se à Teoria da Perda de uma Chance, quando serão tecidos comentários sobre o enquadramento dessa modalidade no direito e processo eleitoral; e, por fim, são apresentados, exemplificativamente, os eventos em que a situação tem aptidão para ser aplicada. Em considerações finais, avalia-se a relevância que a medida tem para moralizar as eleições.It analyzes the possibility of redressing the damages resulting from illegal acts practiced during the election and with the potential to cause the loss of the chance of candidates to ascend to power. It is expected that the indirect coercion exerted by this phenomenon will, at least in part, hinder the practice of illicit acts during the electoral contest. It is thus intended to provide protection to both candidates and society itself. The development begins with the concept and most important points of Civil Responsibility, followed by the Theory of Loss of a Chance, when will be made comments on the framework of this modality in the law and electoral process and, finally, examples, the events in which the situation may be applied. In the end, it is evaluated the relevance that the measure has to moralize the elections.
