Representatividade feminina no processo eleitoral brasileiro : avanços e desafios na busca por igualdade

Abstract

O reconhecimento das mulheres enquanto sujeitas de direito passou por longo processo de luta, dentro do qual destacam-se os manifestos a favor do direito ao voto e à candidatura feminina. Em razão disso, este artigo visa analisar a eficácia da Lei n. 12.034/2009 e os seus reflexos no sistema eleitoral brasileiro. O artigo também propõe reflexão acerca dos desafios ainda encontrados no tocante à inserção das mulheres no âmbito político. Foram utilizados os métodos teórico-bibliográfico e hipotético-dedutivo nas consultas a doutrinas, leis, artigos e reportagens relacionadas ao tema, bem como foi feito estudo quantitativo por meio dos dados disponíveis do Tribunal Superior Eleitoral (TSE) que tratam da eleição de mulheres nos pleitos eleitorais da Câmara Federal nos anos de 1982 a 2022.

The recognition of women as law subjects has gone through a long process of struggle, within which the manifests in favor of the right to vote and the female candidacy stand out. For this reason, the present research aims to analyze the effectiveness of the law n. 12.034/2009 and its reverberations on the Brazilian electoral system. The paper also proposes a reflection on the challenges still encountered with regard to the inclusion of women in the political context. The theoretical-bibliographical and hypothetical-deductive methods were used, through the analysis of doctrines, laws, articles and reports related to the theme, as well as a quantitative study was carried out through the available data of the TSE that deal with the election of women in the electoral contests of the federal chamber in the years 1982 to 2022.
