Da democracia formal à democracia substancial

Abstract

Pretende definir democracia como processo de formação da ordem social e também do Estado, a partir do pensamento de Hans Kelsen. O autor fixa dois fundamentos essenciais à democracia: liberdade e igualdade, restringindo-se a concepção formal do regime democrático. Em contra-partida, pretendese ainda analisar o aspecto substancial da democracia, que pode promover a concretização de outros direitos fundamentais além do direito de participação popular nas decisões de governo, como defende Luigi Ferrajoli.It intends to define democracy as an arrangement process of the social order and the State as well, from the considerations of Hans Kelsen. The author presents two essential beddings to the democracy: freedom and equality, restricting itself to the formal conception of the democratic structure. In counterpart, it is still intended to analyze the substantial aspect of the democracy, which is able to promote the concretion of other basic rights beyond the right of popular participation in the government decisions, as Luigi Ferrajoli defends.
