Bens jurídico-eleitorais e revisão da decisão das urnas

Abstract

Discute os bens jurídico-eleitorais contemplados no art. 14, § 9º, da Constituição Federal. Após apresentar uma noção de bem jurídico e sua relevância no Direito, passa-se a explicitação de possíveis sentidos daqueles bens. São também tratadas as formas de controle de investidura político-eletiva e a legitimidade de seu exercício pela Justiça Eleitoral.It discusses the legal-electoral assets contemplated in art. 14, paragraph 9, of the Federal Constitution. After presenting a notion of legal good and its relevance in the Law, we pass on the explanation of possible meanings of those goods. Also treated are the forms of control of political-elective investiture and the legitimacy of its exercise by the Electoral Justice.
