Estudo da modificação legal e jurisprudencial e da impossibilidade de financiamento de campanhas eleitorais por parte de pessoas jurídicas

Abstract

A Constituição da República de 1988 e todo seu regramento infraconstitucional e jurisprudencial trazem dentre outros mandamentos, as regras eleitorais em âmbito- nacional, regional e municipal. A Lei das Eleições (Lei nº 9.504/1997), em seu texto anterior, legitimava a possibilidade de pessoas jurídicas fazer doação para o financiamento das campanhas eleitorais em todo o país, entretanto com a descoberta de crimes cometidos pelo recebimento indevido de valores em troca de favores entre particulares e a classe política, evidenciou-se a necessidade de investigar tais práticas criminosas e de realizar a modificação legal sobre o tema. Com o início das investigações policiais, surgiu então a discussão de setores da sociedade sobre a necessidade de endurecer as regras eleitorais, sobretudo no que tange a punibilidade do agente que já praticou crime ou continua a praticar contra a Administração Pública. O presente estudo visa acompanhar o recorte temporal entre 201 O e 2017 da evolução infraconstitucional e da jurisprudência e os efeitos eleitorais, especialmente com a aprovação da Lei Complementar nº 135, de 4 de junho de 2010, mais conhecida como "Lei da Ficha Limpa", o julgamento da ADIN 4.650/DF, os resultados práticos da Lei nº 13.165/2015, que acabou por revogar alguns dispositivos da Lei das Eleições, especialmente no que diz respeito aos efeitos da revogação do financiamento das campanhas eleitorais por parte de pessoas jurídicas. Por fim, os efeitos da limitação orçamentária nas campanhas eleitorais proposta pela Lei nº 13.488/2017.

The Constitution of the Republic of 1988 and ali infra-constitutional and jurisprudential regulations bring, among other commandments, the electoral rules at the national, regional and municipal leveis. The Law on Elections (Law No. 9,504 / 1997), in its previous text, legitimized the possibility of legal entities donating to the financing of electoral campaigns throughout the country, however with the discovery of crimes committed by the improper receipt of amounts in exchange of favors between private enterprises and tbe political class, since tben the need to investigate such criminal practices and the legal modification on the subject has been evident. With the beginning of the police investigations, emerged tbe discussion of sectors of society on the need to tighten electoral rules, especially regarding the punishment of the agent who has already co1mnitted crime or continues to practice against the Public Administration. This study aims to follow the historical cut between 201 O and 2017 of infra-constitutional evolution and jurispmdence and electoral effects, especially with the approval of Complementary Law 135, of June 4, 2010, better known as "Lei da Ficha Limpa", the ADIN 4.650 / DF, the practical results of Law No. 13,165 / 2015, which eventually repealed some propositions of the Election Law, especially about the effects of the revocation of the electoral campaigns financing by private enterprises. Finally, the effects of budgetary limitation on electoral campaigns proposed by Law nº 13,488/2017.
