A súmula 62 do Tribunal Superior Eleitoral e os problemas para a efetividade do contraditório substancial

Abstract

Aborda as dificuldades para o pleno exercício do contraditório advindas da adoção de uma concepção do processo com caráter individualista e centrada na figura do magistrado, o que também condicionou a leitura, no processo civil, da teoria da substancialização da causa de pedir. A Súmula 62 do Tribunal Superior Eleitoral, ao estabelecer que a parte se defende dos fatos demarcados na inicial e de modo desgarrado da capitulação jurídica, mostra-se aferrada a este paradigma, vulnerando as garantias das partes no processo judicial eleitoral, sendo necessário o devido ajuste para fazê-la adequada ao princípio do contraditório em seu cenário democrático e dialógico.

It addresses the difficulties for the full exercise of the contradiction arising from the adoption of a conception of the process with an individualistic character and centered on the figure of the magistrate, which also conditioned, in the civil process, the reading of the theory of substantiation of the cause of asking. Supreme Court's Precedent 62, establishing that the party defends the facts demarcated in the initial and in a torn way from the legal capitulation, shows itself to be attached to this paradigm, violating the guarantees of the parties in the electoral judicial process, being necessary due adjustment to make it adequate to the principle of contradictory in its democratic and dialogical scenario.
