A liberdade de expressão e a disseminação de notícias preordenadas à turbação dos pleitos eleitorais

Abstract

O fenômeno das notícias adrede falsificadas (fake news) durante o processo eleitoral brasileiro deve ser analisado a partir dos direitos fundamentais conexos à liberdade de expressão. A disseminação de notícias falsas durante o processo eleitoral pode distorcer o resultado de um pleito eleitoral e afetar a formação livre da vontade popular. Importa estudar de que maneira o direito eleitoral poderia coibir a disseminação de notícias falsas, mais especificamente via internet, no âmbito das redes sociais, sem prejudicar a liberdade de expressão. Destacou- se como o fenômeno das fake news afeta diretamente uma eleição, esclarecendo seu conceito e tentando demonstrar o alcance que tal fenômeno possui diante da tecnologia. Nesse sentido, demonstrou-se como os eleitores passam a disseminar essas notícias falsas e sua penetração nos discursos democráticos eleitorais.The phenomenon of fake news during the Brazilian electoral process must be analyzed from the perspective of the fundamental rights related to freedom of speech. The dissemination of fake news during the electoral process can distort the outcome of an election and affect the free formation of the popular will. It is important to study how electoral law could curb the dissemination of fake news, more specifically via the internet, in the context of social networks, without harming freedom of speech. We intend to highlight how the fake news phenomenon directly affects an election, clarifying its concept and trying to demonstrate the scope that such a phenomenon has in relation to technology. In this sense, we demonstrated how voters start to disseminate this fake news and its penetration in electoral democratic discourses.
