Abstract

Tem como objetivo demonstrar como a criação da fase do pré-registro de candidatura, utilizando as técnicas do processo estrutural, contribuirá para que a Justiça Eleitoral possa julgar de forma definitiva, quase todos os candidatos antes das eleições, sanando o estado de desconformidade existente, atualmente, no processo eleitoral. Os benefícios advindos da implementação deste instituto serão inúmeros, atingindo todos os atores que participam deste período, em especial, na garantia de que serão respeitados os princípios da razoável duração do processo, da soberania popular, da representatividade e da legitimidade das eleições.It aims to demonstrate how the creation of the candidacy preregistration phase, using structural process techniques, will contribute to the Electoral court being able to definitively judge almost all candidates before the elections, remedying the existing state of non compliance currently in the electoral process. The benefits arising from the implementation of this institute will be countless, reaching all actors participating in this period, in particular the guarantee that the principles of reasonable duration of the process, popular sovereignty, representativeness and legitimacy of the elections will be respected.
